The Strategic Role of the Republic of Indonesia National Police Institution in the Concept of a Legal State

As a State Instrument that Maintains Security and Order whose position is directly under the President, which means that the President has the authority to appoint and dismiss the National Police Chief. The purpose of this research is to analyze and determine the position of the National Police institution in the institutional structure in Indonesia and the ideal position of the National Police in the institutional structure in Indonesia. The research method used in this study is the Normative Research Method by analyzing the provisions of laws and regulations related to the position of the National Police. The results of the research show that, First: The position of the National Police Institution is currently under the President as an independent security and law enforcement officer. This position is in accordance with the 1945 Constitution. Second: The ideal position of the National Police in the future is to remain directly under the President who is supervised internally through the Divpropam and the Code of Ethics Commission of the National Police of the Republic of Indonesia (KKEP) while the National Police Commission is an external institution tasked with supervising the performance of the National Police.
