MECOAK TUMBANG : ANTARA SANKSI ADAT DAN PENCEGAHAN PERKAWINAN SEDARAH DALAM HUKUM ADAT DI PETULAI SELUPU REJANG

Abstract

The purpose of this study is to determine the form of implementation of Mecoak Tumbang customary sanctions in the Rejang tribe in Petulai selupu Rejang, Rejang Lebong Regency. and to find out how the inhibiting factors for the occurrence of Mecoak Tumbang marriage sanctions in the Petulai selupu Rejang customary society of Rejang Lebong Regency. Using empirical research methods. The results of this study show: (1) the procedure for implementing customary sanctions for one poyang marriage which includes, time, place, things that need to be prepared, parties involved, to the decision to impose sanctions, (2) the inhibiting factor for the Mecoak Tumbang marriage sanction is the lack of socialization regarding the application of customary sanctions for Mecoak Tumbang marriage, The inhibiting factor from the customary institution or customary deliberation body lacks legal power in enforcing sanctions because it does not have coercive power which causes weak authority, the inhibiting factor from the party implementing Mecoak Tumbang, the perpetrator will be sanctioned based on customary deliberations against one poyang marriage that has been reported by the community, but there are times when these efforts experience obstacles such as families who do not want to know about these customary sanctions.
