PENEGAKAN HUKUM DALAM TINDAK PIDANA PENYELUNDUPAN PAKAIAN BEKAS (STUDI PERAN BEA CUKAI DI KOTA BENGKULU)

Abstract

This study aims to determine the law enforcement in terms of the laws governing the smuggling of used clothing in Bengkulu City. This type of research is empirical research directly in the field to see existing events. Data collection techniques are field observation, interviews with research informants, and documentation of research results. Based on the results of the research, there are zero cases of smuggling in Bengkulu City because of the lack of strict supervision, all used clothing items are distributed by land. So that causes. Although there are zero cases, the distribution and sale of used clothing has been very much like in Panorama Market, UNIB Belakang, and Bumi Ayu who have made sales even though it is prohibited in Law Number 17 of 2006 concerning Customs, all of which have stated the sanctions and Law Number 7 of 2014 concerning Trade which provides sanctions for the sale of goods without a license. Although there are no cases, the efforts given by Customs still exist if smugglers are caught.
